The Court Theatre (charity no. CC11114) ("The Court") is an independent and full theatre production house. It manages its own ticketing services as well as provides ticketing services, including the sale and distribution of tickets as an agent for venues, promoters or persons responsible for holding similar performances.

 

 

 

 

 

 

Please read these Terms and Conditions carefully before purchasing a ticket. By purchasing a ticket from The Court, you agree to be bound by these Terms and Conditions.

These Terms and Conditions relate both to the sale of tickets and attendance at performances. These Terms and Conditions apply to both the original purchaser and any subsequent ticketholders.

The Court’s Privacy Policy prohibits it from sharing to a third party the contact information of any persons purchasing tickets, products or services.

The Court complies with the guarantees in the Consumer Guarantees Act 1993 (CGA).

1. Variation to Terms and Conditions

The Court may vary these Terms and Conditions at any time by updating them. Any variations will only apply to ticket purchases made after these Terms and Conditions have been updated.

2. Terms and Conditions: for a specific venue

Each ticket sold may also be subject to any additional terms and conditions of a particular performance and/or venue. These Terms may be disclosed on The Court's website and/or at The Court’s Box Office at the time of purchase.

3. Refunds, exchanges and Court Credits

When asking for a refund please be sympathetic to The Court’s situation as a not-for-profit, live theatre company. Please consider accepting an exchange or a Court Credit. You may wish to donate the value of your ticket and/or associated products to The Court (you’ll receive a receipt for tax purposes for any donation of $5 or more).

3.1. If a performance is cancelled, The Court will offer to refund, exchange or “Court Credit” the full value of the ticket(s), including the booking fee. The Court will also offer to refund, exchange or “Court Credit” Court products associated with the cancelled show or production, including food, beverage and programme vouchers.

3.2. If a performance is rescheduled or significantly relocated (and you're unable to attend the rescheduled or relocated show or a production), The Court will offer to refund, exchange or “Court Credit” the full value of the ticket(s), including the booking fee. The Court will also offer to refund, exchange or “Court Credit” Court products associated with the rescheduled or significantly relocated show or production, including food, beverage and programme vouchers.

3.3. If a performance is postponed but no new date has been announced, The Court will offer to refund, exchange or “Court Credit” the full value of the ticket(s), including the booking fee. The Court will also offer to refund, exchange or “Court Credit” Court products associated with the cancelled show or production, including food, beverage and programme vouchers.

3.4. Refunds, exchanges or Court Credits as a result of a change in your personal circumstances is at the sole discretion of The Court. Refunds, exchanges or Court Credits will not be considered if The Court Theatre is not notified at least two hours prior to the start of the performance.

3.5. Where possible refunds will be processed to the credit card originally used for purchase. If the ticket(s) were purchased using a non-credit card method then the name and bank account details of the purchaser is required for processing.

3.6. Delivery Fees are non-refundable.

4. Gift Vouchers

Gift vouchers are available to purchase via The Court’s website, or via Box Office at The Court and whilst they are non-refundable, they remain valid for up to twelve months. Please note that purchasing a gift voucher does not guarantee a ticket to a performance. Gift Vouchers cannot be exchanged for cash.

5. ALSO CONSIDER...

Carefully consider the refund and cancellation policies of travel, accommodation and other goods or service providers when making arrangements for attendance at a performance. You may wish to consider taking out a relevant insurance policy to cover for any losses in case show is cancelled, rescheduled or relocated. In case a show is cancelled, rescheduled or relocated, The Court Theatre is not responsible for any losses associated with travel, accommodation and other goods or service providers. 

6. Variations to performances

6.1. The Court reserves the right to add, withdraw, reschedule or substitute artists and/or vary advertised programs, prices, venues, seating arrangements and audience capacity.

6.2. If reserved seating is impacted due to variations to a performance, then next best available seating is allocated. Please notify The Court if you have specific seating requirements. Please be aware that The Court is unable to guarantee seating.

7. Conditions of entry

7.1. Purchasing a ticket requires the following information: First Name, Last Name, Email Address and Phone Number. Additional information may be required for specific programmes/performances.

7.2. Admission to a performance is subject to The Court's Terms and/or the Terms and Conditions: for a specific venue or a specific performance.

7.3. Entry to a performance may be denied where The Court or specific venue management has reasonable grounds to do so, including a breach of The Court’s and/or a specific venue ‘s Terms and Conditions, or you are intoxicated or adversely affecting the enjoyment of the event by others.

7.4. Removal from a performance may occur where The Court or specific venue management has reasonable grounds to do so, including a breach of The Court’s and/or a specific venue ‘s Terms and Conditions, or you are intoxicated or adversely affecting the enjoyment of the event by others.

7.5. Entry to an event may be refused if the authenticity or validity of a ticket is questionable, including because the ticket has been damaged or defaced in any way, or has not been purchased using The Court’s ticketing services.

7.6. If you arrive late, you may not be admitted unless, at the discretion of The Court’s and/or specific venue management, there is a convenient break in the programme.

7.7. It may be necessary to show the relevant ID at the venue where the event is presented for any tickets purchased online at a discount price, including student, 65+ concession, Hāpai Access Card, Community Services Card, 30 Below or Student discount, etc

7.8. You may not be permitted to take into the performance, or use, cameras or other photographic or recording equipment (including mobile phones).

7.9. A child is aged three - seventeen inclusive.

7.10. Children aged from three years must be seated in their own ticketed seat with their caregiver/supervisor and be supervised at all times

7.11. Children aged two and under will not be allocated a ticketed seat and therefore are able to attend free of charge. They must be supervised at all times. You will need to book and pay for a ticketed seat if a child aged two and under requires a seat.

8. COVID-19 specific conditions of entry

8.1. If you are attending the performance as part of a group, as the primary ticket purchaser, you are responsible for knowing the contact details of all attendees in your group (including their full name, contact email and contact phone number). In the event you are contacted directly by the Ministry of Health for the purposes of contact tracing, you must make these details available to the Ministry of Health for that purpose.

8.2. As the primary ticket purchaser, you are responsible for forwarding all pre-performance information received from The Court and/or the performance venue to all attendees in your group. This information outlines The Courts’ and/or performance venue’s expectations of behaviour as it relates to Covid-19, eg mask (wearing a mask), scan (using the NZ COVID Tracer app to scan in), pass (present valid Covid Vaccination Pass)

8.3. It is The Court’s and/or performance venue’s responsibility to provide NZ COVID Tracer QR codes at points of entry, and around the venue as per the current Government Guidelines.

9. Conditions of web-based bookings

9.1. By purchasing tickets on The Court’s website, you are agreeing to be bound by The Court’s Terms and Conditions of Sale. Please read these Terms and Conditions carefully.

9.2. The Court assumes no responsibility for any error, omission, interruption, deletion, defect, delay in transmission or line failure.

9.3. Your use of the material on The Court website is at your sole risk.

9.4. The Court reserves the right to change the details on this website at any time.

9.5. If you choose not to be bound by The Court’s Ticketing Terms and Conditions of Sale please do not purchase tickets through this site.

10. Resale of tickets & scalping

Tickets may not, without the prior written consent from The Court, be:

-      resold or offered for resale;

-      used for advertising, promotion or other commercial purposes (including competitions and trade promotions);

-      used to enhance the demand for other goods or services

If a ticket is sold or used in breach of this condition, the ticket may be cancelled without a refund and the ticketholder may be refused admission.

SCALPING WARNING: The resale of tickets in certain circumstances is governed by ticket sales legislation and may attract criminal penalties.

11. Collection and delivery of tickets

11.1. Delivery of tickets is via email.

11.2. As part of the purchasing process, you may choose to pick your tickets up from the venue ("Hold at Box Office") on the night of the performance. Please, collect your tickets at least 20 minutes prior to the performance start time.

11.3. The Court may change the delivery method to "Hold at Box Office" at its discretion.
